To be considered for inclusion in the Policysure Website, you must:

Be based in the UK and be able to deliver goods anywhere in the country. All prices should be displayed and transactions made in pounds sterling. Not have any hidden costs added at the checkout (eg.VAT). A total price must be clearly displayed before the transaction is completed. Use a secure facility to capture credit card details - either SSL encryption or 128-bit Java encryption. List a UK contact address, telephone number and email address on the site. Sell products from your own range, not simply through an affiliate scheme. Offer products that are acceptable to Policysure's family-orientated ethos. Offer a varied and comprehensive range of products. Must clearly state delivery timescales on the site. Be hosted with your own unique domain name. State a refunds policy.

Listings on Policysure's website are subject to editorial discretion. We reserve the right to refuse a listing to any site we deem unsuitable. Meeting the criteria will not necessarily guarantee a listing.

Application for listing

Policysure Limited (Policysure) is not committed to accept any application for a listing and any offer to list contained in this site or otherwise made to you is an invitation to apply, subject to contract. Upon acceptance of your application by Policysure (this will be conveyed to you by email) there shall be deemed to be a contract between Policysure and the applicant on the terms set out herein.

Placement and Rating of Listing

Policysure reserves the right to place the Listing in such a place, position, order and category within the Website as it determines. You agree and consent to have your site reviewed and ranked by Policysure. Any such review and ranking shall be at the sole discretion of Policysure. If you disagree with the review or ranking of your site your sole remedy shall be to request Policysure to remove the Listing. Policysure reserves the right to, at any time and without notice, enhance, modify, alter, suspend or permanently discontinue all or any part of the Website and to restrict or prohibit access to it. You accept that such changes may result in the amendment or removal of your Listing. Subject to its editorial discretion, Policysure will make all reasonable efforts to ensure that the information it provides about your site is consistent with the information provided as part of any application. Policysure does not warrant that the access to the Website or any Listing by you or other users will be uninterrupted or free of error.

Your Obligations

You agree, at your own expense, to provide such further technical and other information and materials about your site as Policysure may reasonably require in order to enable and administer the Listing. Policysure cannot warrant that it can provide a listing in the absence of appropriate information or compatible technology. You agree to immediately notify Policysure if there are any material changes to the content, structure or functionality of your site that would affect the Listing or its review, ranking or categorisation. You agree to respond to any reasonable queries about your site in an appropriate and timely manner regardless of whether such queries are made by visitors to your site or are referred to you by Policysure. You represent and warrant that (i) you will not provide any false or misleading information as part of any application, (ii) any material provided to Policysure will not infringe the rights of any third party (including but not limited to any copyright, trademark or other intellectual property rights), and (iii) any such material will not contain any viruses, worms or other such programs or code of a destructive nature (iv)any such material will not be illegal, degrading, defamatory or tending to lower the reputation of the Policysure Website or any linked site. Policysure's duties and obligations to you are limited to the services and facilities expressly provided for in these terms. The setting up, maintenance and operation of your site, compliance with the law, the exercise of a duty of care and compliance with contractual terms shall at all times remain your responsibility. You hereby agree to indemnify, defend and hold Policysure and its employees, agents and representatives harmless from and against any costs, claims or losses and damages (including any legal fees) incurred by or awarded against Policysure or its employees, agents and representatives as a result of (i) your misuse of the Listing; or (ii) your breach of these terms and conditions (iii) the operation of your Website.

Termination of Listing

Policysure can only feature a limited number of sites on its Website. Accordingly, Policysure must reserves its editorial discretion and its right to remove any site and terminate any agreement to include such a Listing at its sole discretion. Policysure's decision to remove any Listing shall be final. Policysure may, at your request, provide comments or guidelines to assist you to regain a Listing. Policysure's decision to remove your existing Listing does not prohibit you from seeking a new Listing. If you are in breach of these terms and conditions Policysure may, at its option, suspend or permanently remove your Listing and suspend your access to the Website. Any such breach may also result in Policysure refusing to consider future applications for a Listing.

No warranty

Except in respect of liability for death and personal injury arising out of its own negligence, Policysure hereby disclaims and excludes to the fullest extent permitted by law all liability for any loss or damage of any kind whatsoever including but not limited to any indirect, special, consequential or secondary loss or damage or any loss of profit, time, contracts or goodwill or anticipated savings incurred by you as a result of the operation or content of the Listing or the Website or any software, code or material provided to you in relation to this. Your remedy shall in any case be limited to the removal of your Listing from the Website. Policysure excludes any representations and/or warranties of any kind in connection with the Website or the Listing whether express or implied to the fullest extent permissible by law including (but not limited to) the satisfactory quality, fitness for purpose and non-infringement of proprietary or third party rights.

Ownership of content

The copyright, trademark and all other intellectual property rights used as part of the Website including but not limited to the content, coding, music, photographs, video, design, software, illustrations, names and logos (the "Content") are licensed to or owned by Policysure. Unless otherwise agreed in writing, your Listing on the Website does not entitle you to use or display any part of the Content or the Policysure name, logo or insignia or to make any part of the Website available as part of another website whether by hyperlink, frame or otherwise.

General

Any information provided by you as part of the application will be treated as confidential and shall be used only for the purpose of administering the Listing. The information may however be used in an aggregated statistical format to assist Policysure in evaluating the Website and may also be disclosed to a third party if required by law. These terms and conditions set out the entire agreement between you and Policysure. Except for the case of fraudulent misrepresentation any variation to these terms and conditions is not valid unless executed in writing and signed by you and a director of Policysure. If a court of competent jurisdiction decides that any part of these terms and conditions are unenforceable then the enforceability of the remainder shall be unaffected. Any notice given pursuant to these terms and conditions may be delivered by hand or by first class mail and shall be deemed to have been delivered 2 days after posting. Electronic mail shall be deemed to have been delivered when sent. Any delay by Policysure in exercising its rights under these terms and conditions shall not be construed as a waiver and shall not be construed as an acceptance of any such breach. These terms and conditions shall be subject to English Law and the parties agree to the exclusive jurisdiction of the English Courts.
